Hearing:  February 25, 2019  7PM
Cheshire Annex

Present: Donna M. Defino, Francis M. Griswold, Peter H. Traub, Ronald W. DeAngelis, Nick Graham, and Sandra Sloane

Invited Guest:    Ed St. John, IV, Town Administrator

Donna opened the meeting at 7:00pm.

SK Design submitted plans and a Form A for Cheshire MA 2, LLC, Wilshire Drive Extension and Ingalls Road.  Map 217/202; Lots 37/28; Book  1403/851; Page 769 (Hutchinson) 1164 Whitney property. (Not a building lot)
Donna asked for a motion of approval.  Fran motioned to approve the plan as submitted; seconded by Nick.  A unanimous vote was taken.

Brian E.Koczela, BEK Associates, submitted a Form A for Sand Mill Road.  Peter reviewed the bylaw check list and all documentation presented was approved.  A motion to approve was voiced by Ron and was seconded by Nick.  A unanimous vote was taken. (1031 Sand Mill Road.  Book 1013; Lot 23.)

Dean Smith, Borrego solar plan on 203 East Harbor Road submitted a Form A, a copy of Order of Conditions from the Cheshire Conservation Commission and maps to document any changes from the original submissions.  Mr. Smith requested small trees to be planted.  
Donna reminded Mr. Smith that the size of ten (10) feet was what the CPB requested and as Nick stated, “What was agreed upon.  Ten (10) foot trees; 5 feet on center and staggered.”

Donna did not require a list of changes but wanted corrected plans.  Mr. Smith said he would send them out tomorrow, 2/26/19.

Donna:  “There will be a ten (10) foot space; five (5) feet apart; staggered with ten (10) foot trees.”

Mr. Smith submitted a letter from Tom Benjamin, a Landscape Design, Planning Construction Management, Maintenance Guidance, Permitting professional.

The discussion with Mr. Smith ended at 7:38PM.

Donna asked several attending individuals if they were present to speak on marijuana cultivation.  The answer was, “Yes.”  However, Donna stated that they were not on the Agenda and the CPB could not discuss their issues or concerns.  Donna did remind all that the Town of Cheshire does have a Marijuana By Law in place.  Additionally, handouts were given at the last annual town meeting.  

Francis Maguire of Stafford Green Inc. requested to be placed on the March 25, 2019 Planning Board Agenda.  Mr. Maguire is the individual interested in having an outdoor cultivation of marijuana on his property at Stafford Hill, Cheshire, MA.

A representative from Berkshire Regional Planning, Matthew Dovell, presented a map outlining the town for possible sites for light industrial zoning.  The CPB reviewed each site and discussed if the plan satisfies the Green Community light industrial for correct usage.

Donna will be checking the Right to Farm guidelines and will report back regarding AR District possible modifications.

In an effort to move forward to meet deadlines for a submission of a bylaw to the Attorney General, the next meeting will take place on Wednesday, March 13, 2019 at 6:00PM in the Annex.  At that time, BRPC will have changed the map areas for possible light industrial and will have started the process of writing the bylaw.

The next regular meeting will be:  Monday, March 25, 2019 - Town Annex at 7PM.

With no further business, Peter motioned to adjourn; 2nd by Nick with a unanimous vote taken at 8:30PM.
